Terms of Service

These terms are the agreement between you and Firmitek when you use our websites or buy Chemistbook. Please read them before you pay.
Who we are
Firmitek is the trading name of Kwaku Ampem Affram, a sole trader in Accra, Ghana. In these terms, "we" and "us" mean Firmitek, and "you" means the person or business using our sites or buying from us.

What these terms cover
- Using this site, the Chemistbook site and the Chemistbook demo.
- Buying Chemistbook, our software for shops licensed as over-the-counter medicine sellers.
Project work for clients, such as identity, access and audit services, is agreed in a separate written proposal, and for that work the proposal applies instead of these terms.
Using our sites
You may read our sites and link to them. They describe our work; nothing on them is legal or regulatory advice.
The demo is a shared sample shop that anyone can sign in to. Use it to try Chemistbook, not to keep real records, and do not enter real people's details into it. It is reset to its sample data from time to time, which deletes whatever was entered.
Do not try to break into, overload or disrupt our sites or the demo, or use them to attack anyone else.
Our sites link to others, such as LinkedIn, WhatsApp and Paystack. Those sites have their own terms, and we are not responsible for them.
We work to keep our sites accurate and available, but we may change them, and they may sometimes be unavailable.
Buying Chemistbook
What you get
Before you pay, we send you a written quote. It sets out what you are buying: a licence for one shop to use Chemistbook on the shop's own PC, and anything else the quote lists, such as installation, setup, or updates and support for a stated period. Where the quote and these terms differ, the quote applies.
Price and payment
Prices are in Ghana cedis and are the ones in your quote. We do not charge for anything the quote does not show.
You pay through Paystack, by the methods Paystack offers when you pay. Your card or mobile money details go to Paystack, not to us, and we never see your full card number or your PIN.
Installation
We agree a date with you and install Chemistbook on a PC the shop provides, which must meet the requirements in the quote. Your licence starts when installation is complete.
Refunds
- Before we start work for your shop, you can cancel and we refund your payment in full.
- Once installation or setup has started, we refund only for what has not been delivered, such as a period of support that has not begun. Work already done is not refunded.
To ask for a refund, write to affram.dev@gmail.com with your payment reference. We refund through Paystack to the card or mobile money account you paid from where Paystack allows it, and otherwise by transfer to an account in your name. How long the money then takes to reach you depends on your bank or mobile money provider.
Nothing in these terms takes away a right that the law of Ghana gives you.
Your shop's part
Chemistbook helps a shop keep to its licence. It does not replace the licence holder's duties: what a shop may sell, and how, is set by the Pharmacy Council and the Food and Drugs Authority, and following their rules remains the shop's responsibility.
Chemistbook runs on the shop's own PC. Keep that PC, its power supply, the backup drive and the backup passphrase safe: we cannot recover records from a PC or a backup we do not have.
Your shop's records
The records your shop keeps in Chemistbook belong to your shop. They include personal information about its staff and its suppliers' contact people, and your shop is the data controller for it under Ghana's Data Protection Act, 2012, responsible for it under that Act, including registering with the Data Protection Commission.
When we install Chemistbook or help with a problem, we may see or handle those records on your shop's behalf. When we do, we:
- act only as your shop authorises, and only for that work;
- keep what we see confidential, and give it to no one unless the law requires it;
- protect it with appropriate security measures, and tell you as soon as we reasonably can if anyone not allowed to reaches it;
- delete any copy we made once the work is done.
This section is the written contract the Act requires between a data controller and anyone who processes personal data on its behalf.
The software
Chemistbook remains ours. Your licence lets your shop use it; it does not let anyone copy, resell or share it.
If something goes wrong
We fix faults in Chemistbook that you report to us during the support period in your quote. Beyond what the quote and these terms promise, we do not guarantee that Chemistbook will be free of faults or suit every shop.
Our total liability to you for any claim about Chemistbook is limited to what you paid us for it in the twelve months before the claim, and we are not liable for indirect losses such as lost profit. These limits do not apply where the law does not allow them.
Ending your licence
You can stop using Chemistbook at any time. We can end your licence if a payment due under the quote is not made, or if the software is copied or misused, after telling you why in writing and giving you a reasonable chance to put it right. When a licence ends, your shop's records stay on its PC and remain yours.
Changes to these terms
We may update these terms, and the date at the top shows when they last changed. A change does not affect a purchase already paid for, which stays under the terms in force when you paid.
Law and disputes
These terms are governed by the laws of Ghana. If we disagree, we will first try to settle it by talking to each other; if that fails, the courts of Ghana will decide.
